These terms are an agreement between you and Sidekick Labs LLC (“we”, “us”) covering the Samantha app and the interpretation service reached through it. By creating an account or placing a call, you agree to them. If you do not agree, do not use the service.
1. Samantha is not for emergencies
Samantha cannot call 911 or any emergency service, and must never be relied on in an emergency. It is not a telephone service, does not support emergency calling, and does not transmit your location to emergency responders. In an emergency, hang up and dial your local emergency number directly.
2. What the service does, and its limits
Samantha uses automated speech recognition and artificial intelligence to interpret spoken conversation between two languages in real time. It is software, not a person.
Automated interpretation makes mistakes. It can mishear words, misread context, drop nuance, mistranslate idioms and names, and occasionally produce output that is fluent but wrong. Accuracy varies by language, accent, background noise, connection quality, and subject matter.
Because of this, you must not rely on Samantha as the sole means of communication where an error could cause harm. In particular, do not use Samantha in place of a qualified human interpreter for:
- Medical diagnosis, treatment decisions, consent, or any clinical encounter
- Legal proceedings, sworn testimony, contracts, or legal advice
- Financial commitments or any binding agreement
- Emergency, safety-critical, or life-threatening situations
- Any setting where law or regulation requires a certified interpreter
You are responsible for judging whether automated interpretation is appropriate for your situation.
3. Your account
- You must be at least 18 years old, or the age of majority where you live, to hold an account.
- Provide accurate information and keep it current.
- You are responsible for everything that happens under your account, and for keeping your password and your call PINs confidential.
- One account per person. The free trial is limited to one per person and one per phone number.
- Tell us promptly if you believe your account has been used without your permission.
4. The phone number and your PIN
The number you dial to reach the service, and the PIN issued for each call, are for your use alone. Do not publish, share, resell, or distribute either. We may suspend or terminate an account that does. PINs are single use and expire shortly after being issued.
5. Minutes, purchases, and refunds
- Samantha is prepaid. You buy minutes in advance and they are drawn down as you use them.
- Calls are billed per started minute. A call lasting sixty-one seconds is charged as two minutes.
- Purchased minutes do not expire while your account is open. They are forfeited if you delete your account.
- Minutes have no cash value, cannot be redeemed for cash, and cannot be transferred to another account or another person.
- If a call ends up costing more than your remaining balance, we absorb the difference for that call rather than cutting you off mid-conversation. Your balance will not go below zero.
- Prices may change. A change never affects minutes you have already purchased.
Refunds are handled by Google Play, not by us. All purchases are processed by Google as merchant of record. To request a refund, use Google Play’s refund process, which is subject to Google’s own policies and time limits. We can help you find the right form, but we cannot issue, approve, or reverse a Google Play charge ourselves.
6. Acceptable use
You agree not to use Samantha to:
- Break any law, or facilitate anyone else in doing so
- Harass, threaten, defraud, impersonate, or abuse anyone
- Record or transcribe a conversation without the consent of everyone on the call, where consent is required by law
- Place unsolicited bulk, automated, or telemarketing calls
- Resell, rebrand, or provide the service to third parties as though it were your own
- Probe, scan, reverse engineer, or interfere with the service or its security, or attempt to obtain the underlying phone number by any means other than the app
- Circumvent the free trial limits, billing, or any usage cap
- Generate or attempt to elicit content that is illegal, or that sexualizes minors
7. Consent to interpretation
Interpretation involves two people. You are responsible for telling the other party that an automated interpreter is on the call, and for obtaining any consent that the law where either of you is located requires before enabling a transcript. Several US states require all parties to consent. Comply with the strictest rule that applies to your call.
8. Availability
We aim to keep Samantha running but do not promise uninterrupted service. It depends on telephone networks, internet connectivity, and third-party AI and telephony providers, none of which we control. We may suspend the service for maintenance, and may change or discontinue features. If we discontinue the service entirely, we will give reasonable notice in the app and provide a means to request a refund of unused minutes through Google Play where their policies permit.
9. Your content
You keep all rights to what you say and to any transcript generated from it. You grant us only the limited permission needed to run the service: to process your call audio for interpretation, and to store a transcript if you have asked for one. We do not use your conversations to train AI models, and we do not permit our providers to use them to train general-purpose models. See the privacy policy for full detail.
10. Termination
You may stop using Samantha and delete your account at any time through the account deletion page. We may suspend or terminate an account that violates these terms, that we reasonably believe is engaged in fraud or abuse, or where required by law. Where circumstances allow, we will give notice first. If we terminate your account without cause, we will refund unused minutes to the extent Google Play’s policies permit.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT INTERPRETATION WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SIDEKICK LABS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING ANY ERROR OR OMISSION IN INTERPRETATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
13. Indemnity
You agree to indemnify and hold harmless Sidekick Labs LLC from claims and costs arising out of your use of the service in breach of these terms or in violation of law, including any claim brought by another party to a call regarding consent to interpretation or transcription.
14. Governing law and disputes
These terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Washington, and you and we each consent to their jurisdiction.
15. Changes to these terms
We may update these terms. If a change is material, we will notify you in the app before it takes effect and revise the date at the top of this page. Continuing to use the service after a change takes effect means you accept the revised terms. If you do not accept them, delete your account.
16. General
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. These terms and the privacy policy are the entire agreement between you and us about the service.
